1. Definitions

In these Terms, unless otherwise stated:

“Herbwoman”, “we”, “our”, or “us” refers to Falkasete AS, reg. no. NO988195154VAT, located at Skreddarstuva 141, 4160 Finnøy, Norway, which operates the Herbwoman website and brand.
“Website” means https://herbwoman.comhttps://herbwoman.com/island and all associated subdomains.
“Consumer” refers to a natural person acting outside their trade, business, or profession, in accordance with Article 2(1) of Directive 2011/83/EU.
“Business Customer” means any individual or legal entity purchasing for professional use.
“Goods” include seeds, natural cosmetics, and any related products offered for sale.
“Working Day” means Monday to Friday, excluding Norwegian public holidays.

2. Scope & Acceptance

These Terms apply to all online and distance sales of Goods by Falkasete AS to Consumers and Business Customers in the European Union, EEA, and United Kingdom. By placing an order, you accept these Terms. Conflicting purchaser terms are not binding unless explicitly agreed in writing.

3. Ordering Process

Product listings include descriptions, VAT-inclusive pricing (where applicable), and availability.
Orders are placed by adding Goods to the cart, entering delivery and payment details, and confirming the order.
You can review and correct input before final submission.
You will receive an email confirmation upon submission. The contract is formed upon email confirmation or invoice issuance for Business Customers.

4. Prices & Payment

Prices are shown in euros (EUR) and include VAT unless otherwise stated.
Shipping costs are calculated at checkout.
Accepted payment methods: Visa, MasterCard, PayPal, Apple Pay, and bank transfer.
Charges are made upon dispatch.
Invoices for Business Customers are due within 14 days unless otherwise agreed. Ownership remains with Falkasete AS until full payment is received.

5. Shipping & Delivery

We ship to EU/EEA countries and the UK via DHL or Iceland Post.
Estimated delivery time is shown at checkout.
Risk transfers to Consumers upon delivery; to Business Customers upon handover to the carrier.
Customers are responsible for local phytosanitary and import compliance. Customs fees are the responsibility of the purchaser.

6. Consumer Right of Withdrawal

As a Consumer, you have the right to withdraw from the contract within 14 days of delivery without providing any reason.

To exercise this right:

Notify us using the contact details in Section 14 with a clear withdrawal statement (email or letter).
You may use the Model Withdrawal Form (Appendix 1), but it is not required.

Return Deadline: Return Goods within 14 days of withdrawal notice.

Refund Deadline: Refunds will be processed within 14 days of notice or receipt of Goods/proof of return. Standard delivery costs will be refunded. Refunds are issued using the original payment method unless agreed otherwise.

Return Shipping Costs: You are responsible for return shipping unless Goods were defective or incorrectly delivered.

7. Withdrawal & Return Exceptions

The right of withdrawal does not apply to:

Goods that expire quickly, such as opened seed packets.
Unsealed goods not suitable for return for hygiene reasons (e.g., opened cosmetics).
Custom-made or personalised items.
Purchases by Business Customers (see Section 8).

8. Business Customer Returns

No statutory withdrawal rights apply.
At our discretion, unopened, resaleable items may be returned within 14 days with a 15% restocking fee. Return shipping is at the buyer’s expense.
Defective Goods must be reported within 5 Working Days. Remedies are limited to replacement or credit.

9. Returns Procedure

Email support@https://herbwoman.comhttps://herbwoman.com/island with your order number and reason for return.
Pack items securely and include proof of purchase.
Clearly label the return with the RA number provided.

Use a tracked service. We are not responsible for items lost in transit.

10. Warranty & Defects

Consumers are entitled to statutory rights under EU law (Directive 1999/44/EC and 2019/771/EU).
Seeds are guaranteed based on laboratory-tested germination rates until the “sow-by” date.
Cosmetics display shelf life or PAO (Period After Opening).
If Goods are defective, we will repair, replace, or refund at no cost.

11. Liability

We do not exclude liability for death, personal injury, or fraud.
No liability for indirect losses (e.g., lost profits, data).
Business Customer liability is limited to the purchase price of the Goods.

12. Force Majeure

We are not responsible for delays or non-performance caused by events beyond our control, such as natural disasters, pandemics, strikes, or legal restrictions.
